Our terms of service and privacy policy.
Notice of upcoming change, effective October 26, 2026
Starting October 26, 2026, we may sell and share certain personal information with third parties, as described in Section 05. This is a change from our previous policy, which stated that we did not sell personal information. Where you have expressly consented by accepting the updated Terms of Service, this applies to information we collected about you before that date as well as after it; where you have not, it applies only from October 26, 2026 onward. You can opt out at any time, before or after that date, at Do Not Sell or Share My Personal Information.
MediaMaxxing.com("Platform," "we," "us," or "our") is committed to protecting the privacy of our users ("User," "Creator," "Brand," "you"). This Privacy Policy explains what information we collect, how we use it, and the choices you have regarding your data.
By using MediaMaxxing, you agree to the collection and use of information as described in this policy. If you do not agree, please do not use the Platform.
When you create an account and complete onboarding, we collect:
When you use the Platform, we collect:
If you connect third-party accounts (such as Discord or social media platforms), we collect your username or user ID on those platforms to verify your identity and track content performance.
When you choose to authorize MediaMaxxing to access your Instagram, TikTok or YouTube account, we receive an access token from that platform and, depending on the permissions you grant, we access:
We only access these through the official platform APIs, only for the purposes described in this policy, and only while your authorization is active.
To process payouts, we collect banking or payment details you provide. Payment processing is handled by third-party providers and we do not store full bank account or card numbers on our servers.
We automatically collect certain technical information when you visit the Platform, including:
We use the information we collect to:
Beginning October 26, 2026, we may sell or share the following categories of personal information with third parties for their own commercial purposes, including marketing, market research, recruiting, audience measurement, and model development. Where you expressly consented by accepting the updated Terms of Service, this includes information we collected about you before that date:
Categories of recipients include brand and advertiser partners, marketing and audience-measurement providers, talent and recruiting platforms, data analytics providers, and companies developing artificial intelligence or machine learning products.
We do not sell or share any of the following, anywhere, and opting out is not required to keep them excluded:
Where the law of your state restricts or prohibits the sale, lease, trade, or other profiting from biometric identifiers and biometric information, including facial geometry and voiceprints, we do not sell or share yours. Illinois, Texas, and Washington residents are covered by such laws. Elsewhere, biometric information is not among the categories listed above that we may sell or share.
We never sell or share the personal information of anyone under 13. For users aged 13 to 17, the rule depends on where you live. Where your state bars the sale of a known minor's personal information or requires affirmative opt-in consent for it, we do not sell or share yours without that consent. California, Connecticut, Colorado, Maryland, New Jersey, Delaware, Oregon, and Florida residents are covered by such rules. Where we do not hold a verified date of birth, we apply the most protective rule available to that account.
Where applicable law requires separate, revocable, or opt-in consent for any sale or sharing described in this Section, or prohibits a particular sale outright, that law controls and we sell or share only to the fullest extent it permits. The remainder of this Section stays in full force for everyone else. Rights described here that are granted by a specific state's law are available to residents of that state; we extend the opt-out itself to everyone regardless of where they live.
You can opt out at any time, and the choice takes effect immediately:
Opting out does not affect your account, your campaign access, your rates, or your payouts. We will not discriminate against you for opting out.
We retain your personal information for as long as your account is active or as needed to provide you with our services. If you request account deletion, we will remove your personal data within 30 days, except where we are required to retain it for legal, tax, or fraud prevention purposes.
Performance data and earnings records may be retained for up to 7 years to comply with tax and financial reporting obligations.
We use industry-standard security measures to protect your information, including encrypted connections (TLS/SSL), secure database hosting, and role-based access controls. However, no method of transmission over the internet is 100% secure, and we cannot guarantee absolute security.
You can access and update your account information at any time through your account settings.
You may request deletion of your account by contacting us. Upon deletion, your personal information will be removed, subject to any legal retention requirements.
You can revoke our access at any time from the platform itself: in Instagram, Settings, then Apps and websites; in TikTok, Settings, then Security, then Manage app permissions; in Google, your account's Third-party connections page. Once access is revoked we can no longer read or post to that account. To also have the data we already received from it deleted, follow the steps on our data deletion page.
You may opt out of non-essential communications at any time. Transactional messages related to your account, payouts, or campaigns cannot be opted out of while your account is active.
You may direct us to stop selling and sharing your personal information at any time, using any of the methods in Section 05. The choice takes effect immediately and we honor it regardless of where you live.
If you are a California resident, you have additional rights under the California Consumer Privacy Act, as amended by the California Privacy Rights Act. These include the right to know what personal information we collect, use, disclose, sell, and share; the right to access a copy of it; the right to correct it; the right to request its deletion; the right to limit our use of sensitive personal information; and the right to opt out of its sale and sharing.
To opt out of the sale and sharing of your personal information, use the Do Not Sell or Share My Personal Information page, or enable Global Privacy Control in your browser. We treat the Global Privacy Control signal as a valid opt-out request. To exercise any other right, contact us using the information below. You may also use an authorized agent, and we will ask for proof of their permission to act for you.
We will not deny you service, charge you a different price, or give you a lower level of quality because you exercised any of these rights. Section 05 lists the categories of personal information we may sell or share, the categories of third parties who may receive it, and the categories we never sell or share.
Residents of other states with comparable privacy laws, including Colorado, Connecticut, Virginia, Utah, Texas, Oregon, and Montana, have similar rights and may use the same methods to exercise them.
Users must be at least 13 years old to use the Platform. We do not knowingly collect personal information from children under 13. If we become aware that we have collected data from a child under 13, we will delete it promptly. Users between 13 and 18 require parental consent to participate in monetization programs.
We may update this Privacy Policy from time to time. If we make material changes, we will notify you via email or a prominent notice on the Platform at least 30 days before the changes take effect. Your continued use of the Platform after any changes constitutes acceptance of the updated policy.
